Cutting Fitness Ltd – Terms & Conditions

 

These Terms and Conditions govern the use of the facilities, memberships and services provided by Cutting Fitness Ltd. By purchasing a membership, booking a Personal Training session, attending a Small Group Training session, or using our members' gym, you agree to be bound by these Terms and Conditions.

1. Memberships and Services - Cutting Fitness Ltd provides the following services: 1:1 Personal Training, Small Group Training, Members' Gym Access, Additional coaching, events and fitness services as offered from time to time. Memberships, training packages and session credits are non-transferable and may only be used by the named account holder.

2. Eligibility - Clients must be at least 18 years of age to become a member or purchase any services from Cutting Fitness Ltd. By joining, you confirm that all information provided is accurate and up to date.

3. Bookings and Payments - Bookings must be made through our booking platform, or payment processor. Payment must be made before attendance unless otherwise agreed. Membership fees, packages and session prices may be amended at any time. 

4. Membership Terms - Memberships continue in accordance with the agreement selected at the time of purchase. Memberships are personal and cannot be shared, transferred or assigned to another individual. Failure to use your membership does not entitle you to refunds or extensions unless specifically stated within these Terms.

5. Session Expiry - Personal Training sessions, Small Group Training sessions and class credits may have expiry dates. Any unused sessions remaining after their expiry date will be forfeited. All PT & Small group sessions are to be used per month sub and don't roll over.

6. Class Cancellation Policy - Clients must provide at least 24 hours' notice if they wish to cancel or reschedule a booked Personal Training or Small Group Training session. Cancellations made with less than 24 hours' notice will result in the loss of that session. No refunds or replacement sessions will be issued for late cancellations.

7. No Shows - Failure to attend a booked session without cancelling will be treated as a No Show. No Shows will result in: Loss of the booked session, No refund,  No replacement credit. Repeated No Shows may result in restrictions on future bookings or termination of membership.

8. Late Arrivals - Please arrive min 5 minutes before your scheduled session. Sessions will always finish at their scheduled end time regardless of arrival time. If you arrive late, your session will not be extended. Clients arriving more than 10 minutes late may be refused participation due to: Missing the warm-up, Increased injury risk, Disruption to other members and coaching sessions. The decision to refuse participation rests solely with the coach.

9. Refund Policy - All memberships, Personal Training packages, Small Group Training packages and other services are non-refundable. No refunds will be issued for:Change of mind, Lack of attendance, Illness (unless required by law), Holidays, Failure to achieve desired results. Exceptional circumstances may be considered entirely at the discretion of Cutting Fitness Ltd.

10. Membership Freezes - Members may freeze their membership once during any rolling 12-month period for a maximum of one month. Freeze requests must be submitted in writing before the requested freeze date. Memberships cannot be frozen retrospectively.

11. Health Declaration - By participating in any training session you confirm that:You are medically fit to exercise. You have disclosed any medical conditions that may affect your participation. You understand exercise carries an element of risk. You participate entirely at your own risk. Clients are responsible for informing their coach of any changes to their health.

12. Pregnancy Policy - Clients must inform their coach as soon as they become aware they are pregnant .Exercise can often continue safely throughout pregnancy; however, modifications may be required. Particular care will be taken during the first 12 weeks of pregnancy, where coaches may modify or remove certain exercises to prioritise the safety of both mother and baby. Clients should always seek advice from their healthcare professional before exercising during pregnancy.

13. Health and Safety - All members agree to:Follow coach instructions at all times.Use equipment correctly. Return all equipment after use. Wipe down equipment after use where cleaning products are provided. Wear suitable exercise clothing and clean training footwear. Coaches reserve the right to stop any exercise they believe may place a client at risk.

14. Gym Etiquette - To create a positive training environment, members agree to: Treat staff and members with respect. Keep noise to an appropriate level. Return all weights and equipment after use. Report damaged equipment immediately. Respect the facilities and other users. Aggressive, abusive or inappropriate behaviour towards staff or members will not be tolerated.

15. Personal Belongings - All personal belongings are brought onto the premises at the owner's own risk.Cutting Fitness Ltd accepts no responsibility for loss, theft or damage to personal property.

16. Photography and Filming - Photography and filming may occasionally take place for promotional purposes. If you do not wish to appear in photographs or videos, please notify a member of staff before your session.We will always make reasonable efforts to respect your wishes.

17. Limitation of Liability - Participation in exercise carries inherent risks.To the fullest extent permitted by law, Cutting Fitness Ltd shall not be liable for: Injury resulting from misuse of equipment. Injury caused by failure to follow coach instructions. Loss or damage to personal belongings. Indirect or consequential losses arising from participation in our services.Nothing within these Terms excludes liability where it cannot legally be excluded under UK law.

18. Suspension or Termination - Cutting Fitness Ltd reserves the right to suspend or terminate any membership without refund where a member: Breaches these Terms. Behaves aggressively or abusively. Places themselves or others at risk. Deliberately damages equipment. Repeatedly fails to comply with gym policies.

19. Changes to Services - We reserve the right to:Amend class timetables. Change coaches. Alter opening hours. Replace equipment. Update membership options. Temporarily close facilities for maintenance or unforeseen circumstances. Where reasonably possible, members will be given advance notice.

20. Force Majeure- Cutting Fitness Ltd shall not be liable for any interruption of services caused by circumstances beyond our reasonable control, including but not limited to: Extreme weathe, Fire, Flood, Government restrictions, Pandemics, Power outages, Industrial disputes

21. Privacy - Your personal information will be processed in accordance with our Privacy Policy and applicable UK data protection legislation.

22. Changes to These Terms - Cutting Fitness Ltd reserves the right to amend these Terms and Conditions at any time. The latest version will always be available on our website. Continued use of our services constitutes acceptance of any updated Terms.

23. Governing Law - These Terms and Conditions shall be governed by and interpreted in accordance with the laws of  England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

25. Membership Cancellation - All personal training, Small Group and Members Gym memberships cancellations require a minimum of 30 days notice. This may include one final payment depending on when you give notice. Ie if your membership payment runs on the 5th every month and you give notice on the 25th, you will have 1 final payment before membership is finished.

By purchasing a membership, booking a session or attending any facility operated by Cutting Fitness Ltd, you confirm that you have read, understood and agree to these Terms and Conditions.
